‘Lack of coherence in promoting mediation for civil and commercial disputes: the Italian case’

For about two yers (2010-2012), mandatory mediation has existed in Italy. The reactions arised, the mistakes made, the misinformation given and the successes obtained offer interesting insights on how to promote mediation in a concrete way, so testing „in the field” the suggestions given by the Council of Europe. The way in which Italian law was finally transformed, ending that experiment, brings to reflect if there is a lobby against mediation. Is an Ec directive sufficient to develop mediation in the continent or more concrete action is required?

Accordingly to U.N. Guidelines, “Effective mediation requires a supportive external environment … The actions of other States can help to reinforce a mediated solution or detract from it … a mediator must be accepted, credible and well supported (p.5) … However, support from civil society and other stakeholders cannot be taken for granted, as some of these actors may have hard-line positions and oppose the mediation (p.11)”.

Jo Holland, CEO Small Claims Mediation – Leicester, is a  CEDR trained and accredited mediator specializing in small claim disputes. Her experience extends to in excess of 800 mediations. Jo was a civil servant who went through a tough assessment process to determine if she had natural skills to become a mediator, she was successful and promoted to senior manager level and undertook her training by CEDR. Unlike most mediators fresh out of training, Jo took over the East Midlands Court Circuit and set up the HMCTS Small Claims Mediation Service. Jo achieved a settlement rate of 90% and 100% client satisfaction.

Having spent 20 years in the Civil Service, and looking for a new challenge, Jo made the decision to leave to realise her dream of setting up her own private mediation practice. Using her knowledge of the HMCTS model she has developed a service offering proportionate dispute resolution using telephone and has extended that model to include ODR in light of the EU Directive on ADR/ODR Consumer Redress. Jo’s aim was to create an affordable accessible service for users and steady work for mediators and has established herself as the market leader in small claims mediation. Jo has a large panel of mediators working across the UK and has developed links in other European countries to establish her type of mediation service for small claim disputes. Jo has challenged the way disputes are resolved and has raised the profile of mediation, demonstrating to large organisations the huge benefits of using mediation rather than adjudication.

She convinced the largest UK Government backed tenancy deposit scheme to run a mediation pilot alongside their adjudication scheme, the pilot has already demonstrated faster dispute resolution, reduction in complaints, higher customer satisfaction and significant cost savings for the not for profit organisation. Her proposal to the largest UK law firm franchise was accepted and the launch for a joint small claims service is expected January 2014. Whilst sounding like a cliche, Jo has the kind of passion and determination that will ensure she continues to bring small claims under the spotlight, and as a result reduces the burden on the courts that the high volume of these disputes creates.

Lorraine Schaffer, LL.M. was the Director of the Centre for Mediation and Conflict Resolution at the Institute of Family Therapy in London from July 2001 to August 2010 and Chair of a Postgraduate programme of courses in Conflict Resolution and Mediation studies at Birkbeck College, University of London. Lorraine was a practising family mediator for 15 years, beginning as a trainee at Eye to Eye in South London in 1995. Before that she worked as a social worker with adolescents and families, taught on the Brunel social work course and also specialised in social group work. Lorraine co-taught the family mediation module on the LLM at Westminster School of Law for several years. She was a group presenter for the mediation information meetings pilot for the Family Law Act and was an elected Governor of the UK College of Family Mediators for six years.

Abstract:

Still all about the process or is theory important? Is mediation a profession in its own right?

Mediation and dispute resolution processes in all realms require skilled interventions.  Conflicts vary in intensity, but are by nature complex and if left unaddressed, the consequences can be very serious.  I contend that we have a duty to consider the training and support mediators and other CR practitioners receive, if they are to meet these challenges. It takes between 2- 6 years to train in most professions;  is it acceptable that in the UK and many other countries people can be trained as mediators in as few as 5 days?

Relevance to Conference:

Although my field of practice was family mediation, when teaching the postgraduate programme at Birkbeck College we included lectures on international conflict resolution, community, educational, and other forms of mediation as well as a broad range of theories of conflict and approaches to managing conflict. I think that the issue of whether theory is taught in all areas of mediation practice is relevant to the themes of this conference. Unless we have a more unified and coherent body of knowledge underpinning mediation training I do not believe we can be seen or trusted as professionals in our own right; until mediators and conflict specialists in all areas join together in promoting mediation to the public, we will not achieve our potential in addressing conflicts experienced by individuals, couples, families, workplaces as well as the prevention and management of conflicts facing international communities.

Dr. Ralph Steele has been a mediator since 1992 and has conducted over 8000 hours of mediation, including more than ten years experience in the mediation of business and family issues.  He has received two doctorate degrees – one in Civil Law and Mediation and a Ph.D. in Psychology from Oxford University.  He is both a TMCA Credentialed Distinguished Mediator and a Board Certified Professional Counselor (by the American Psychotherapy Association and the Texas Board of Examiners of Professional Counselors).  His undergraduate degree is from Concordia University, and he holds a Master of Divinity degree from Vanderbilt University.  Dr. Steele honorably served as a United States naval officer and is devoted to developing our youth as future leaders who make a positive impact on society.

In addition to being a mediator and a counselor, Dr. Steele also teaches mediation skills to others.  In 1992 he conducted peer mediation and peer mediation training and wrote a book entitled the School Conflict Resolution Mediation Program.  He also developed the Mediation Certificate Program at the University of Texas at Arlington and is on the faculty of that program.  His Irving-based business, Mediation Worlds, PLLC, not only provides mediation services, but also offers basic and advanced mediation training and a Mediation Fellows Program for current mediators.  This fellowship gives mediators opportunities to increase their knowledge and skills to the highest competency level.  It is the intent of the fellowship program to assist mediators in being able to mediate in any setting. Dr. Steele has recently written two books on the mediation profession, entitled Save Millions with Conflict Coaching:  A Cross-Cultural Conflict Coaching Methodology and Model (February, 2011) and Facts, Issues, Options, and Solutions (May, 2013).

In Iraq and Afghanistan, he served as the Special Governance Advisor to Senior U.S. Military Officers and its units, Local Government Officials, and Senior U.S. Federal Government Officials. Carlos received the U.S. Department of State Meritorious Award for turning around the Maiwand District – known as the birthplace of the Taliban, was awarded the U.S. Army Task Force 1st Battalion 2nd Infantry Regiment Service Award, and was recognized by the Iraqi and Afghan government for his commitment to public service.

Among her most important proposals is to assist the task of contracting using alternative transactional languages, such as sound, gestures or graphics.
